Okay, it seems a lot of kids on this site still don't get it, so I would like to post this reminder.

When you submit a deviation, you have to click a box that verifies that "[You] have read and agree to the Submission Policy and/or contest rules if applicable." And what does it say in that submission policy?

This is the agreement ("Agreement") between you as either an individual artist or as the legal authorized representative of a group artist ("Artist") and deviantART Inc., ("deviantART") concerning the uploading of Artist's audio, visual, audiovisual and other materials (the "Artist Materials" defined below) to the deviantART.com website or any successor(s) websites and/or websites to which the contents in whole or in part of deviantArt.com are assigned (the "deviantART Site(s)") and concerning deviantART's use of Artist Materials on the deviantART Site(s).
Condensed down into basic English, it means you are verifying that you are the owner of the content being posted as a deviation. Meaning it's something you made yourself, created out of valid stock material, or commissioned another artist to produce for you.

FAQ #257: What sort of permission do I need to use someone else's work?

DeviantART is a site for posting up artwork of your own creation. It is not a site for posting up scans of comic pages, or screen-captures from movies or TV. It doesn't matter if you worked "hard" to "clean up" the scans or captures, you didn't create it, so you don't deserve to post it.

FAQ #306: Does "Crediting" let me use whatever I want?

The staff running deviantART walk a fine tightrope of legalities to allow us to use this site. They work hard to make sure things are fair and square here. As such, they simply can not allow copywritten material posted without the express permission of the copyright owners. This site shouldn't be abused.

Not to mention it's rather unfair to the real artists on this site, who have to contend with their original material getting drowned out by the clamor of stolen material. (And without legal permission, it IS stolen, even if you don't claim it's yours.)

So don't get pissy if you have scans or screencaps and someone asks you nicely to take them down. Better yet, stop posting up stolen art that isn't yours here and just go use your Photobucket or Facebook or tumblr (or whatever other site is currently trendy) instead.

Am I seriously the only one here who reads my fucking journal posts?!? My journal post "My contribution to deviantart" somehow states in the beginning that I SUCK at making and creating digital art Hence "until I develop the real skill and patience to make good digital art with GIMP 2.8"!!!
     This ruins my entire chances of actually doing something worth everybody on Deviantart's time besides just making comments that nobody listens to. If I can't edit actual images that other people on Deviantart have made WITH THEIR PERMISSION, then there's not a single way I'm going to improve to the point where I become an actual creator of good digital ART!

  Just answer me this one question: Is it not illegal to post screencaps UNLESS YOU CREDIT THE OWNER OR COMPANY OF THE SERIES THAT THE CHARACTER, EVENT, THING, AND/OR PLACE BELONGS TO!!! Such as My Little Pony: Friendship Is Magic belonging to Hasbro, and Lauren Faust!!! Such as Code Geass belonging to Sunrise!!! Is it not illegal to post screencaps if the owners of the series' in the image posted are credited or stated?

Written permission? From the owner/owners, itself/themselves? A.K.A, From huge companies? That don't associate themselves with niether the community, nor the loving fan-base, nor the mere "commoners", the mere "average Joe's" such as us people not in the big-leagues that they believe us to be? Don't make me laugh!


Tell me, since when do those huge companies who create the shows and movies and cartoons that we love and watch and wish to barter and enhance the happiness; that those shows, movies, and cartoons bring us, ever...and I mean, EVER, in all the history and understandability of companies and their very existence, give permission to do anything with their creations, to we, the people; who they believe are the SMALLER, LESSER ones, who are SO average, and uninteresting and...dare I say it my friend; undeserving of their creations?



     Can you, with all of your possible understanding of what I just said, answer the question that I have just laid out for you?

Well with that attitude, you're certainly undeserving.

The fact of the matter is, DeviantArt is for posting work that people have made themselves. Don't act like you're "contributing" to this site with cheap screengrabs that you doodled on a little bit. If you want to put that online, you have every right to,--just not on DA. This site isn't for stuff like that. Myself, I would rather be part of the solution, not the problem.

Then tell me, what is your interpretation of the solution?

   Is it that rule of sticking to what people have made, themselves? Sticking to the "incorruptible" script That Deviantart should be a site for work people have made themselves?

   To just waste away your body, heart, and even very SOUL for the will of this "law" waiting until someone commits an "art" crime and then chasing after them like there's no tomorrow until you've finally caught and jailed the culprit responsible for such an "unforgivable" act?

   ...That is even "done" by a person who has been innocent the entire time...

   Friend... I'm only going to say and ask this as many times as I need to for it to get through to you...

   Think about this! What about...the people who aren't CAPABLE, of making art themselves until they gain a-lot of experience, and there's almost no way how...? What about the ones who are so inexperienced in the game of art? Can you imagine what they see in that game? How they feel in it? They feel terrible, friend...and do you know why? Because They see everyone walking around in that game, who know every Gosh-damned way to win in existence AND flaunt their knowledge of those ways to win, and also flaunt their skills at that game, and then they expect the inexperienced to know all of those ways to win, and have all of those skills too, and then not even BOTHER to be generous and teach them how to win in those ways and teach them those skills!?!?

   Don't you understand...? There are some people who are so inexperienced with certain things, and nobody tries to help them, because they're so STUBBORN and involved at their game-play, that when they and the other skilled, easily winning ones that they're partnered with fail, or die, or get a game-over, they blame it all on the inexperienced player in some way, and it's just not fair to the one who is inexperienced, for he has done nothing wrong to make them fail or die or get a game-over, and therefore doesn't deserve it!!!

   I, am one of those people...

   One of those people who has not ever had ONE person, be kind, generous, and caring enough to be taught...

   All I'm asking for, is just some...damn...HELP!!! Because I have not the PATIENCE for the gears of time to turn and crank as long and slow enough for me to be experienced enough to be as good as everyone else in this DAMN site!!! And I have not the skill to even COMPARE it with the professionals, who do so well that they inspire me! They make the art look so good and so easy to do, but it's NOT! That's why I want to gain the skill, I want to know the ways to win at the game of art! But what happens when you can't learn by you're own action when it comes to complicated image-editing software such as Photoshop and GIMP 2.8...?

So, with that being said, tell me, how did you gain the skill that you have?

Okay, you think facebook, tumblr and photobucket allow screencaps, WRONG.
First of all, Photobucket has a huge problem with art thief, not only they post their screencaps or stolen image, it even allows them to sell it, they didn't allow that, but they aren't doing their jobs.
Second, Facebook could get you sued if you post screencaps or recolors of image on facebook as stated here:

I agree with the point of this, however arguably, scanning in your own comic book or physical work still technically qualifies as "their own art". Same with taking a picture of the same work if it's too big to be scanned in and/or no scanner is available. A screen capture from a movie will only pass *if* the person taking the screenshot actually made the movie in some way or another. Don't forget the legal smokescreen called "fan art".

The problem is that we can't really get this stuff taken down when we find it without asking nicely due to the way the DMCA and dA's site works. And sadly that's the way it should be. But telling entitled kids they can't do what they're doing rarely works without force to back it up.

It annoys the hell out of me too. I tried to ignore it but lately the more I see this stuff it gets to me. It bad enough you have people using the site like it's facebook posting themselves in mass in a mirror but then you have people who screenshot, or go to one of those make a sailor moon character gimmick sites and post it like it's a masterpiece. They work around the rules some how but I'm not letting some of these people get off with crap like this. I'm reporting everyone I see doing screenshots and stealing art. And occasionally the idiots who post hardcore porn. Enough is enough.

Glad to see someone with similar sentiments! I complained about someone posting existing professional comic book cover art as an entry to a contest and winning third place but the group moderators said that their competition rules didn't say 'no copying and pasting allowed' so therefore its fine :S Copyright law comes above deviantART group rules surely!?
